Terms of service

These Terms of Service govern your use of viblitz.com and your purchase of products from us. Viblitz is a trading name of BLACKRHINO TECHNOLOGY LIMITED, Room 1049, Floor 10, Block D, East Sun Industrial Centre, 16 Shing Yip Street, Kwun Tong, Kowloon, Hong Kong SAR ("Viblitz", "we", "us"). By placing an order you agree to these terms. Please read them before you buy.

Who may buy

You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract. By ordering you confirm that the payment method you use is yours and that the details you give us are accurate and complete.

Your account

You may check out as a guest or create an account. If you create one, keep your password confidential and tell us promptly if you believe someone else has used it. You are responsible for activity that happens through your account. We may suspend or close an account that is used for fraud, abuse, resale in breach of these terms, or any unlawful purpose.

Products, descriptions and photography

We describe every product as accurately as we can. Our ceramics, glassware and enamelware are made in small batches, and colour, glaze pooling, outline weight and finish vary a little from piece to piece. That variation is a feature of the way these pieces are made, not a fault. Dimensions and capacities are approximate. Screens render colour differently, so the shade you see may not be an exact match for the piece that arrives.

Prices and payment

All prices are shown in United States dollars and include applicable taxes where stated at checkout. Shipping is calculated and shown before you confirm your order. We may change prices at any time, but a change never affects an order we have already accepted.

Payment is taken when you place your order. We accept the payment methods shown at checkout. If your payment is declined or reversed we may cancel the order. We do not store your full card details; payments are handled by our payment providers.

Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges that we received it, and the contract is formed when we dispatch the goods. We may decline or cancel an order if the item is out of stock, if a price or description was clearly wrong, if we cannot ship to your address, or if we suspect fraud. If we cancel after you have paid, we refund you in full.

Pricing and content errors

Despite our care, a listing may occasionally carry an incorrect price or description. Where the error is obvious and a reasonable person would recognise it as a mistake, we are not obliged to supply at the wrong price. We will contact you, and you may confirm the order at the correct price or cancel it for a full refund.

Delivery

Delivery times, carriers and costs are set out in our Shipping policy, which forms part of these terms. Risk in the goods passes to you when they are delivered to the address you gave us.

Returns and refunds

Your return rights are set out in our Return and refund policy, which forms part of these terms. Nothing in these terms limits any statutory rights you have as a consumer.

Intellectual property

The Viblitz name, our animal illustrations, product photography, written copy and the design of this site belong to us or our licensors. You may not copy, reproduce, adapt or use them commercially without our written permission. Buying a product does not transfer any rights in the artwork applied to it.

Acceptable use

You agree not to use this site to break the law, to interfere with its operation or security, to scrape or harvest data, to place fraudulent or speculative orders, or to upload anything harmful or unlawful. We may restrict access where we reasonably believe this has happened.

Reviews and content you submit

If you submit a review, photograph or other content, you confirm that it is yours to share and you grant us a non-exclusive, royalty-free licence to display and use it in connection with our business. We may remove content that is unlawful, misleading, abusive or off-topic.

Links to other sites

Where we link to a third-party site, we do so for convenience. We do not control those sites and are not responsible for their content, products or privacy practices.

Availability of the site

We aim to keep viblitz.com available, but we do not guarantee uninterrupted access. We may suspend, withdraw or change any part of the site for maintenance or business reasons without notice.

Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data, and our total liability in connection with any order is limited to the amount you paid for that order. We supply our products for domestic and household use; we are not liable for loss arising from commercial use.

Events outside our control

We are not responsible for delay or failure caused by events beyond our reasonable control, including carrier disruption, customs delays, extreme weather, industrial action, power or network failure, or government action. Where such an event affects your order we will contact you and, if the delay is substantial, you may cancel for a full refund.

Changes to these terms

We may update these terms from time to time. The version in force when you place your order is the version that applies to that order. The date at the top shows when this page was last revised.

Governing law

These terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong SAR have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your local law.

General

If any provision of these terms is found to be unenforceable, the remaining provisions continue in force. Our failure to enforce a term is not a waiver of it. These terms, together with our Return and refund policy, Shipping policy and Privacy policy, form the whole agreement between us.
